Main hearing ends in the asphalt cartel damages cases pending in the Court of Appeal

The final statements were presented on 1 October 2015 in the damages cases concerning the so-called asphalt cartel in the Helsinki Court of Appeal. The main hearing began on 2 March 2015 and lasted over 50 court days during which almost 70 witnesses were heard.

Most of the 41 claimants and 7 defendants appealed the judgments given by the District Court of Helsinki on 28 November 2013. The claimants include the State of Finland and cities and municipalities, and the defendants are pavement industry companies.

The State of Finland has presented the largest claims, totaling EUR 56.7 million in capital plus profit and overdue interest. The District Court dismissed the case brought by the State in its entirety. According to the District Court, the State had participated in the cartel and was aware of its existence during the cartel period based on evidence presented.

Judgments are expected to be given during 2016. The actual date remains unclear.

Merilampi represents Skanska Asfaltti Oy in the matter.
